Penalties for DUI

The DMV can only impose one penalty upon any person arrested or convicted of a DUI: a license suspension or revocation. A license revocation is the same as a suspension, but you will be required to rake another driving test when you go to apply for your license. Additionally, the length of the suspension/revocation will depend on the facts of your case and whether you have any prior DUI or alcohol related driving convictions.
First OffenseIf it is your first offense DUI, then the DMV will suspend your license for up to ten months. However, if you refused to submit to a chemical test, then your license will be suspended for one year without the option for a restricted license. Additionally, if you are convicted of DUI causing injury, then your license will be suspended for one year without the option for a restricted license.
